Facts
Gilton (defendant) and Chapman (plaintiff) entered into an oral contract for Chapman to purchase property from Gilton. Chapman paid Gilton a $1,000 down payment for the property. The deal fell through when it appeared that Gilton refused to perform, and Chapman took back the $1,000 down payment. Chapman brought suit against Gilton, and the lower court ruled in favor of Chapman. Gilton appealed.
