Facts
InBev (defendant) was the largest beer brewer in the world but had a small presence in the United States. InBev acquired Anheuser-Busch, the largest brewer in the country, with 50 percent of beer sales. A group of beer consumers (plaintiffs) sued InBev under § 7 of the Clayton Act to stop the merger, arguing that the acquisition eliminated a potential competitor in the beer market. The district court, finding that the beer consumers had not supported their argument with sufficient facts, dismissed the case.
