Facts
Glacier Northwest, Inc. (Glacier) (plaintiff) was a concrete company. Glacier’s truck drivers were members of Teamsters Local Union No. 174 (the union) (defendant). According to Glacier, one morning the drivers reported to work, loaded at least 16 trucks with concrete, and then initiated a strike. According to Glacier, at least nine of those drivers parked their trucks and did not notify Glacier. The timing and the nature of concrete led to a significant amount of concrete being wasted. Glacier was, at least, able to dispel the concrete from its trucks prior to the concrete hardening and thereby destroying the trucks. Glacier sued the union under state law for common-law conversion and trespass to chattels. The trial court dismissed the complaint, finding that it was preempted by the National Labor Relations Act (the act). The court of appeals reversed. The Washington Supreme Court reinstated the trial court’s opinion. The United States Supreme Court granted certiorari.
