Facts
Martin Glass and his sister (plaintiffs) sued Joel Wiener and another person (collectively, Wiener) (defendants), alleging that Wiener forcibly and improperly entered Glass’s deceased parents’ apartment and removed the parents’ property. Per Glass, Wiener’s actions deprived Glass of his rightful possessions and caused him to suffer mental anguish and emotional distress. Glass moved for summary judgment, which the supreme court denied. Glass appealed.
