Facts
J. Glimmerveen (defendant), a Dutch resident, advocated for the exclusion of racial minorities from the Netherlands. The Netherlands (plaintiff) charged Glimmerveen with inciting racial discrimination under the Dutch Criminal Code. Glimmerveen was convicted in Dutch court. Subsequently, Glimmerveen appealed his conviction to the European Commission of Human Rights, which was responsible for enforcing the European Convention on Human Rights (the convention).
