Facts
Gulielma Glover (plaintiff) brought a civil lawsuit for indecent assault against Cornelius Callahan (defendant), alleging that he sexually assaulted her when she was less than 16 years old. The trial court refused to instruct the jury that an assault could not have occurred if Glover consented. The jury found for Glover and Callahan appealed, arguing the trial court should have given a consent instruction.
