Facts
Lisa Goff (plaintiff) was injured in a car accident with a semitruck driven by an employee of Harold Ives Trucking Company, Inc. (Harold Ives) (defendant). Lisa sued and during the case asked for six months of the driver’s driving logs. The logs were required to be kept by federal law. However, the driver had destroyed the logs, and they were never produced. Harold Ives admitted liability, and the jury awarded damages. Lisa then filed a separate action against Harold Ives for spoliation of evidence, requesting punitive damages. Harold Ives moved for dismissal, and the trial court granted the motion.
