Facts
Paris Hilton (defendant) starred in the movie National Lampoon’s Pledge This! Hilton promised the movie’s investors (plaintiffs) that she would promote the film in exchange for $1 million. The movie did not do well at the box office and did not make any money. Michael Goldberg was appointed receiver for any claims that the investors had against Hilton and Paris Hilton Entertainment, Inc. (defendant). Goldberg sued Hilton for breach of contract, alleging that she had failed to promote the film in accordance with the contract. For damages, Goldberg sought $8.3 million, which was the cost of production including the $1 million paid to Hilton. Hilton claimed that she did promote the film properly, and that even if she did not, the movie would not have succeeded with her promotion of the film.
