Facts
The Empire State Development Corporation (ESDC) (defendant), a public agency, sought to condemn property in downtown Brooklyn that was owned by Daniel Goldstein (plaintiff). Goldstein’s property would be included in a land-use improvement project called Atlantic Yards. The ESDC determined that the area in which the project would be situated was blighted and that the project would rehabilitate the area and result in the removal of blight. Goldstein brought suit, contending that it would violate the New York Constitution to condemn his property for the Atlantic Yards project. The appellate division found that it would be constitutionally permissible to condemn Goldstein’s property for the Atlantic Yards project. Goldstein appealed.
