Facts

Jorge Gomez (Gomez) and seven others (plaintiffs) sought class-action certification in a case against the Illinois Board of Education (IBE) and others (defendants) for alleged federal-law violations regarding their rights to equal educational opportunities. The district court dismissed the claims before ruling on class certification. On appeal, the United States Court of Appeals for the Sixth Circuit affirmed the dismissal of two of the claims but reversed and remanded the dismissal of the claims under the Equal Education Opportunities Act (EEOA). The case was then reassigned for decision on class certification. Neither party took issue with the adequacy of the plaintiffs’ class counsel—the Mexican American Legal Defense and Education Fund, Inc. (MALDEF); nevertheless, the court took it upon itself to inquire into the adequacy of class representation.
