Goodman v. 1973 26 Foot Trojan Vessel, Arkansas Registration No. AR1439SN
United States Court of Appeals for the Eighth Circuit
859 F.2d 71 (1988)
- Written by Daniel Clark, JD
Facts
Frank Booth (defendant) rented dock space from James Goodman (plaintiff) and moored his boat there. Booth ceased making rental payments and neglected his boat. The boat eventually sank. Goodman had the boat salvaged and stored after Booth refused to recover it. Goodman then sued Booth in district court, claiming a maritime lien against Booth to recover the unpaid rent. The district court awarded damages. On appeal, Booth argued that his boat was a dead ship and thus that the district court did not have admiralty jurisdiction.
