Facts
Goodman (plaintiff), a Medicare Part B recipient, sued Sullivan (defendant), the Secretary of Health and Human Services, to challenge the secretary’s denial of Goodman’s claim for the cost of magnetic resonance imaging (MRI) that Goodman’s physician had determined was medically necessary to evaluate Goodman’s progressive speech impediment. Goodman challenged the secretary’s policy regarding MRIs and the validity of a Medicare part B regulation denying coverage for any techniques not approved by the secretary, which Goodman argued impermissibly interfered with the practice of medicine.
