Facts
Iowa Code § 28E authorized municipalities to enter into an interlocal agreement. An interlocal agreement allowed municipalities to create a new agency that provided services to the municipalities. Pursuant to § 28E, 14 municipalities (the municipalities) (defendants) entered into an interlocal agreement that created the Des Moines Metropolitan Area Solid Waste Agency (the agency) (defendant). The agency was responsible for developing cooperative strategies for the collection and disposal of solid waste in the municipalities. William Goreham (plaintiff), a taxpayer, brought suit, contending that the creation of the agency was unlawful. The trial court found that the agency was lawfully created. Goreham appealed.
