Facts
GoTo.com, Inc. (plaintiff), an internet-based company, alleged that Walt Disney Co. (defendant) had infringed upon its trademarked logo. GoTo sued Disney under the Lanham Act. The district court granted GoTo’s motion for a preliminary injunction prohibiting Disney from using the allegedly infringing mark. After Disney moved to have the injunction modified, the district court amended the injunction to allow Disney to phase out using the mark. Disney appealed, and the court of appeals stayed the preliminary injunction pending an expedited appeal.
