Facts
Gordon Gould (plaintiff) brought suit against Control Laser Corporation (defendant) for infringement of a patent directed toward laser amplifiers. The United States District Court for the Middle District of Florida stayed proceedings to await the result of a reexamination by the United States Patent and Trademark Office (PTO). Gould appealed to the United States Court of Appeals for the Federal Circuit. Control Laser moved for dismissal, arguing that the stay order did not represent a final decision and was therefore not appealable.
