Facts
Gowen, Inc. (plaintiff) acquired a maritime lien against the F/V Quality One (Quality) (defendant), a vessel. The court ordered public sale of the Quality, along with its fishing permits and history. The Quality’s permits allowed it to fish for certain species, while its history was used to qualify for any future fishing permits. The Quality and its permits were sold, and Gowen sought to enforce its lien against both the vessel and the permits. The court ruled in Gowen’s favor, and the Quality appealed, arguing that its fishing permits were not subject to Gowen’s maritime lien.
