Facts
Jorie Gracen (plaintiff) participated in a painting contest hosted by Bradford Exchange (defendant) to become the featured artist for a line of licensed collector’s plates based on MGM’s “Wizard of Oz” movie. Gracen won the contest with her painting of Dorothy, which was based on a production still of Judy Garland provided for the contest. When Gracen and Bradford failed to agree to terms, Bradford commissioned another artist to redo the painting of Dorothy. Gracen sued Bradford for copyright infringement.
