Grand Bahama Petroleum Co. v. Canadian Transportation Agencies, Ltd.
United States District Court for the Western District of Washington
450 F. Supp. 447, 1978 AMC 789 (1978)

- Written by Carolyn Strutton, JD
Facts
Grand Bahama Petroleum Company (Grand Bahama) (plaintiff) supplied fuel oil to a vessel chartered by Canadian Transportation Agencies, Ltd. (Canadian) (defendant). Canadian failed to pay for the fuel. Canadian had funds in a bank account held by Seattle-First National Bank, located within the forum of the federal district court for the Western District of Washington, but had no other contacts in that forum. Grand Bahama sued Canadian in that court and sought attachment of the bank account under a federal rule of civil procedure that allowed attachment of property for certain maritime claims if the defendant was not present in the forum. Canadian moved to dismiss the action for lack of jurisdiction, alleging that the attachment violated due process.
