Facts
Gerald Grant was shopping in a Stop-N-Go store. The store’s manager, Calhoun, accused Grant of stealing. Grant claimed that Calhoun told him he could not leave and that Calhoun was calling the police. Calhoun claimed he did not tell Grant he could not leave. Calhoun did call the police. Grant claimed that he was afraid of what would happen if he left, so he remained. The police arrived fifteen to twenty minutes later, and took Grant into police custody for about an hour. Grant (plaintiff) brought suit against Stop-N-Go Market of Texas, Inc. (Stop-N-Go) (defendant) for false imprisonment. The trial court granted summary judgment in favor of Stop-N-Go, and Grant appealed.
