Facts
Donna Green (Donna), a senior in high school, was killed in a car accident. Her parents (the Greens) (plaintiffs) brought a wrongful-death action and established liability. Damages were tried before a different jury, which was charged with finding damages consistent with the wrongful-death state statute allowing “such damages... deem[ed] fair and just with reference to the pecuniary injuries” caused by the death. The jury returned a verdict of no damages, apparently finding that Donna’s life was, in a pecuniary sense, worthless to others. The Greens appealed, and the appellate court affirmed. The Greens appealed to the state supreme court.
