Facts
Tamara Green (plaintiff) alleged that Bill Cosby (defendant) sexually assaulted her. Cosby released the following statement to Newsweek magazine through a publicist: “This is a 10-year-old, discredited accusation that proved to be nothing at the time, and is still nothing.” Green brought suit for defamation. Cosby filed a motion to dismiss, arguing, among other things, that the statement was opinion and thus was not defamatory.
