Facts
Roosevelt Green, Jr. (defendant) and Carzell Moore were charged with the rape and murder of Teresa Carol Allen. They were convicted in separate trials. To convict Moore, the prosecution introduced testimony of Thomas Pasby who stated that Moore had confided in him that he had killed Allen. At Green’s second trial to decide whether the death penalty would be imposed, the Green sought to introduce the testimony of Pasby. The trial court excluded the testimony as hearsay and sentenced the defendant to death and the Supreme Court of Georgia affirmed. The United States Supreme Court granted certiorari.
