Facts
George and Hilda (plaintiff) Green were married. To avoid probate, George deposited money in several Totten trust accounts, naming himself trustee for the benefit of his three children (defendants) from a prior marriage. George held the accounts’ passbooks, paid taxes on the interest, and withdrew $2,000 from one of the accounts. George died intestate. The funds of each account were distributed to the children outside of the estate. Hilda sued to recover the distributed funds and bring them into the estate. The trial court ruled for the children. Hilda appealed. The intermediate appellate court affirmed, and Hilda appealed. The supreme court affirmed.
