Facts
Esther Greenberg (plaintiff) was employed as a legal secretary by Checkbureau, Inc. (defendant). Checkbureau terminated Greenberg’s employment for poor job performance, including her repeated failure to spell-check documents and mark court dates on the calendar. Greenberg applied for unemployment benefits. The Arkansas Employment Security Department found that Greenberg was entitled to benefits because she was not discharged for misconduct, and the Arkansas Appeal Tribunal affirmed. Checkbureau appealed to the board of review, which reversed the award of benefits. Greenberg appealed.
