Facts
Gregoire (plaintiff) was arrested by immigration officials and imprisoned from 1942 to 1946 on the grounds that he was German and thus an enemy alien. Gregoire was released after the enemy-alien hearing board determined that Gregoire was French. Gregoire brought suit against two attorneys general, two directors of the Department of Justice enemy-alien control unit, and the district immigration director at Ellis Island (the officials) (defendants). Gregoire alleged that the officials had maliciously conspired to detain him without authority or reasonable cause. Gregoire’s complaint was dismissed for failure to state an actionable claim. Gregoire appealed. The United States Court of Appeals granted certiorari.
