Facts
A class of consumers (the proposed class) (plaintiffs) filed a lawsuit in federal district court against Household Bank (Illinois), N.A. and Golden Seal Heating & Air Conditioning (defendants), alleging violations of state and federal law. The proposed class was represented by Joseph A. Longo, an attorney who had been sanctioned by courts for incompetent lawyering and improper behavior while litigating other consumer class actions. The proposed class moved for class certification. The district court denied the motion, holding that the adequacy requirement from Federal Rule of Civil Procedure (FRCP) 23(a)(4) had not been satisfied because the proposed class’s attorney was not competent to try a class-action lawsuit. The proposed class appealed.
