Facts
Griffith Blacktop, Inc. (Griffith) (plaintiff) signed a contract to help Richard Dillon (defendant) develop his property. After two months, Griffith stopped work on the project and demanded payment for services rendered. Dillon withheld payment and canceled the contract. Griffith sued Dillon for the value of its two months’ work, an amount that Dillon did not dispute. At the close of evidence, the trial court directed the jury to award compensation to Griffith. In addition, the jury found that Dillon was not entitled to an offsetting award of damages. Dillon appealed to the Ohio Court of Appeals.
