Facts
Donald Kuester (defendant) and Kathleen Kuester (defendant) co-owned a boat. Kathleen operated the boat negligently, causing an accident in which Grant Griffith was killed. Donald was not present at the time of the accident. Ann Griffith (plaintiff), the administrator of Grant’s estate, sued both Kathleen and Donald. Anne argued that Donald was vicariously liable for the accident pursuant to the family-purpose doctrine. Donald moved for summary judgment, and the district court considered his motion.
