Facts
Thomas Grimes (plaintiff) sued Employers Mutual Liability Insurance Company (defendant) to recover for personal injuries resulting from an industrial accident. As evidence of his injuries, Grimes wanted to use a videotape of himself performing daily activities and clinical tests. The insurer objected, arguing that the videotape contained inadmissible hearsay. The court ruled on the tape’s admissibility before trial.
