Facts
Lena and Caesaer Grolemund (plaintiffs) were married when Emilio Cafferata, along with the sheriffs of San Francisco and San Mateo counties (defendants) attempted to sell personal property that was Lena and Caesaer’s community property. The sale was part of an execution of a default judgment against Caesaer individually based upon a negligence action that had arisen from a motor vehicle accident in which Caesaer was found individually negligent. Lena and Caesaer petitioned the trial court for a permanent injunction against the sale of their community property for satisfaction of the individual judgment against Caesaer. The trial court denied the injunction. Lena and Caesaer appealed the trial court's decision.
