Facts
Wegman’s Food Markets, Inc. (defendant) decided to vacate premises it leased from Richard Grossman (plaintiff). The original lease called for 15 years, but Wegman’s only leased the property for two years. Part of the agreement also required Wegman’s to pay Grossman a percentage of its sales. Grossman sued, arguing that Wegman’s should be ordered to specifically perform its lease and continue renting the property.
