Facts
Guidance Endodontics, LLC (Guidance) (plaintiff) and Dentsply International, Inc. (Dentsply) (defendant) were parties to a settlement agreement under which Dentsply was Guidance’s exclusive supplier of endodontic products. Dentsply accused Guidance of breaching the agreement and stopped providing products to Guidance. Guidance sued and moved for a temporary restraining order (TRO) to compel Dentsply to supply it with certain products, including the V2, a new product still in development. The parties disagreed about the amount of work required to finalize development and begin manufacturing the V2. After holding evidentiary hearings, the United States District Court for the District of New Mexico ruled on Guidance’s motion.
