Guidry v. Sline Industrial Painters, inc.
Louisiana Supreme Court
418 So. 2d 626 (1982)
- Written by Serena Lipski, JD
Facts
Alcide Guidry was a 53-year-old industrial painter employed by Sline Industrial Painters, Inc. (Sline) (defendant) at the time of his death. On the day he died, Guidry arrived to work at 7:30 a.m. and was directed to repeatedly brace and move a ladder that was 10 to 12 feet tall, which was fairly strenuous work. Guidry worked all day with only a short break at 10:00 a.m. and a lunch break at noon. At 2:00 p.m., just as Guidry began a smoke break, he suffered a fatal myocardial infarction secondary to atherosclerotic heart disease. Guidry’s widow, Mrs. Guidry, filed a claim for workers’-compensation death benefits. Two family physicians testified that Guidry’s heart attack was not causally related to his job duties. A heart specialist testified that there could be a relationship between Guidry’s heart attack and Guidry’s physical activity at work. The judge denied the claim, and the court of appeals reversed. Sline appealed.
