Facts
Attorney Guillermo Cochez Farrugia (plaintiff) asked the Panama minister of the presidency (the minister) (defendant) for information regarding any contract on file signed by Costa Rican national Anabell Diez de Rodriguez. The minister confirmed the existence of a contract signed by Diez de Rodriguez but refused to provide a copy on the grounds that the contract contained personal data regarding a government employee and that it could only be disclosed to a directly interested party, which Cochez Farrugia was not. Upon the minister’s refusal to disclose the contract, Cochez Farrugia petitioned the Panama Supreme Court for a writ of habeas data to compel disclosure of the contract.
