Facts
Nathan Gunsberg (plaintiff) was a registered broker for the sale and purchase of securities. An employee of Roseland Corp. (defendant) told Gunsberg, “Get out of this place you silly stupid senile bum; you are a trouble maker and should be confined to an asylum.” Gunsberg sued Roseland for defamation, arguing that Roseland’s language had injured Gunsberg professionally. Roseland filed a motion to dismiss on the grounds that Gunsberg had not pled slander per se or special damages.
