Facts
Jack Gustafson (defendant) was charged with burglary, attempted theft, and solicitation of murder. At trial, he testified in his own defense. On cross-examination, the prosecution asked Gustafson if, unrelated to the charges at trial, he was guilty of knowingly possessing a stolen pickup truck. Gustafson claimed his Fifth Amendment privilege against self-incrimination, but the trial judge ordered him to answer. Gustafson answered that he had knowingly possessed the truck. The Independence County Circuit Court convicted Gustafson. He appealed.
