Facts
Panama City-Bay County Airport and Industrial District (defendant) owned land acquired through a series of transactions that resulted in a small, privately owned parcel being inaccessible without crossing over property owned by the Industrial District. H & F Land (plaintiff) acquired the small parcel and filed suit claiming the right to a way of necessity across Industrial District land. The industrial district moved for summary judgment on grounds that any claim to easement rights was extinguished pursuant to Florida’s Marketable Record Title Act for failure to give public notice of a claim. The trial court granted the industrial district’s motion for summary judgment and H & F Land appealed. The appellate court affirmed the trial court’s judgment on the motion but certified a single question of law for review by the supreme court.
