Facts
Roberta Hernandez (defendant) was injured by carbon-monoxide fumes while staying on a rental houseboat tied to the shore of Lake Havasu, a navigable body of water. H2O Houseboat Vacations Inc. (H2O) (plaintiff) sued in federal court to limit its liability under the Limitation of Vessel Owner’s Liability Act. The district court ruled in favor of Hernandez, finding that H2O could not claim admiralty jurisdiction over the case. H2O appealed.
