Facts
Headley (plaintiff) contracted to cut and deliver logs to Hackley (defendant). When Headley attempted to collect his payment, Hackley said that he did not owe as much as Headley claimed he did. Headley was in financial straits and needed the money immediately or he would be “ruined financially.” So even though Hackley was not paying as much as Headley claimed he owed, Headley was forced to take it. Headley brought suit to recover the remaining amount owed on the contract. The trial court ruled in favor of Headley and Hackley appealed.
