Facts

Harriet Hagan and Charles Blaisdell (plaintiffs) owned property near Shallcross Lake. The Delaware Anglers’ & Gunners’ Club (the Club) (defendant) owned the land under Shallcross Lake. Hagan and Blaisdell sued the Club to assert their right to fish on the lake. Hagan and Blaisdell had acquired their property through a chain of title that traced back to Mary Shallcross. The original deed from Mary Shallcross to the Club reserved a right to fish the lake for Shallcross, her heirs, and her assigns. Hagan and Blaisdell claimed this reservation of fishing rights ran with Shallcross’s property, and, as the current owners of Shallcross property, these fishing rights applied to them. The trial court ruled against Hagan and Blaisdell. Hagan and Blaisdell appealed.
