Facts
Groce (defendant), an attorney, was retained by a client to prepare testamentary instruments which were to include a bequest to Hale (plaintiff). Groce had failed to include the bequest, but this fact was not learned until after the client died. Hale sought judicial reformation of the testamentary instruments but was denied by the court, whereupon he then brought an action for damages against Groce.
