Facts
LeaAnn Hall and others (plaintiffs) brought several cases against breast-implant manufacturers, including Baxter Healthcare Corp. (defendants), seeking damages for injuries that they claim resulted from silicone-gel breast implants. Hall and the others claimed that the silicone from the breast implants migrated and degraded into their bodies, causing a unique constellation of symptoms, which they referred to as atypical connective tissue disease (ACTD). Hall and the others offered testimony by a number of experts to address a causal link between silicone breast implants and ACTD. Baxter and the others filed a series of motions in limine to exclude Hall’s and the other’s experts’ testimony regarding causation. The court conducted a hearing to address the admissibility of the evidence. The court appointed technical advisors with expertise in each of the fields of Hall’s proposed expert witnesses. The court granted Baxter’s and the other’s motions in limine to exclude Hall’s and the other’s expert testimony concerning causation of any systemic disease or syndrome.
