Facts
Lawrence Hall (plaintiff) sustained injuries to his jaw after being punched by a bouncer while being escorted out of a nightclub. Hall filed suit against the bouncer, John Handka, and his employer, SSF, Inc. (defendants). In Hall’s complaint, he alleged multiple causes of action such as intentional assault, battery, respondeat superior, as well as negligent hiring, training, supervision, and retention. At trial, Hall sought to introduce evidence that Handka was dishonorably discharged from the military for violence and that Handka had been involved in five prior altercations. The trial-court judge refused to admit the evidence to prove any of the causes of action, finding that it constituted improper character evidence. In a bench trial, the judge ultimately found in favor of Hall on the theories of intentional assault, battery, and respondeat superior only. Hall appealed.
