Facts
Roy Salinas was 15 years old. Salinas was convicted of an attempted aggravated assault of a corrections officer, and sentenced to a deferred jail term. While awaiting the start of his sentence, Salinas shot and killed Russell Hamblin during an armed robbery. Salinas had violated the terms of his parole while awaiting his sentence, but Salinas’s parole officer had declined to arrest him. Under Arizona law, a probation officer may use his judgment to decide whether to bring a probationer into court for a probation violation. Hamblin’s family brought a wrongful death suit against the state of Arizona and the Maricopa County Adult Probation Department (the department). The trial court found in favor of the department. The Hamblins appealed.
