Kentucky Court of Appeals

Facts

The Central Kentucky Natural Gas Company (the company) (defendant) extracted natural gas from a field of about 15,000 acres. The company had most of this land under lease. After the company extracted all the natural gas from the field, the company brought additional quantities of gas and stored it in the vacated underground reservoir, in order to withdraw it as needed. Hammonds (plaintiff) owned 54 acres of this land, and the reservoir ran under her land. The company did not lease this land or inform Hammonds of the reservoir. Hammonds sued the company, alleging trespass and seeking compensation for the use and occupation of her land. The trial court found in favor of the company, and Hammonds appealed.
