Facts
James Hansen entered into an agreement with W.G. Stroecker (plaintiff), providing Mr. Stroecker with an option to purchase a portion of Mr. Hansen’s land. This option did not include an expiration date. After Mr. Hansen died, Mr. Stroecker attempted to exercise his option. However, Mr. Hansen’s wife (defendant) refused to deliver the deed to the land. Mr. Stroecker then brought suit, with the trial court determining that the rule against perpetuities was not violated, and that the land should be conveyed to Mr. Stroecker. Mrs. Hansen petitioned for certiorari to the Supreme Court of Alaska.
