Facts
Hardy (plaintiff) mistakenly built a house on land owned by Burroughs (defendant). There were no allegations of fraud or acquiescence by Burroughs to the construction of the house. Burroughs’ tenants under a land contract moved in and started using the house. Hardy brought suit and Burroughs filed a motion to dismiss the complaint. The trial court denied the motion for dismissal. Burroughs appealed.
