United States Court of Appeals for the Second Circuit
636 F.2d 897 (1980)
- Written by Sara Rhee, JD
Facts
Alexander Hargrave (plaintiff), president of Long Island Vineyards (plaintiff), operated a vineyard in New York. In May 1974, the plaintiffs purchased grape vines from Oki Nursery, Inc. (Oki) (defendant). The plaintiffs sued Oki, claiming breach of contract based on the allegation that Oki fraudulently sold diseased vines to the plaintiffs. Oki moved to dismiss the complaint based on the United States District Court’s lack of personal jurisdiction. The District Court granted Oki’s motion and dismissed the complaint.
