Facts
Sleepy’s, LLC (defendant) hired Sam Hargrove and others (workers) (plaintiffs) to deliver mattresses and classified the workers as independent contractors. The workers filed suit in federal court, arguing that they should have been treated as employees, not independent contractors. The district court found that the workers were independent contractors. On appeal, the circuit court petitioned the New Jersey Supreme Court to certify the question of what test should be applied to determine a worker’s status for purposes of the New Jersey Wage Payment Law (WPL) and the New Jersey Wage and Hour Law (WHL). The court granted the petition.
