Facts
Richard Harmon (plaintiff) brought this claim against his brother, Harold Harmon, and Harold’s wife, Virginia Harmon (defendants). Richard alleged that, through undue influence, the defendants convinced Richard’s mother to transfer Richard’s inheritance to them. In his mother’s most recent will, Richard was due to receive at least half of her property, but the transfer effectively disinherited him. Richard brought suit and the Superior Court of Cumberland County dismissed the complaint for failure to state a claim. Richard appealed.
